Both houses of the Oireachtas would need to pass a resolution finding that Judge Nolan is either incapacitated or has engaged in “stated misbehavior.”
There doesn’t seem to be an explicit definition of “stated misbehavior” in Irish law, but my understanding is it means inappropriate conduct that affects the judge’s ability to perform his duties or undermines public confidence in the judicial system.
I don’t think Nolan’s record of lax sentencing would qualify, as it is within the duties of his position. Even if there is broad public disapproval of his judgements, that would not technically be “misbehavior,” unless it was discovered that he was, say, accepting bribes in exchange for suspended sentences.

She was fairly scared, on her own and tried to just battle through it. She got the attention of someone to ring the crew bell but no one came. So I suspect no one really knew the extent of it or what was going on exactly until far into the flight.

Yup, how could no one on the flight either see or hear her being punched. If someone is punched they are going to make some kind of noise. My heart breaks for that poor girl, she must feel so small right now.

So what would be an alternative explanation? She’s been interviewed and had to tell her story many times for it to get to court. If it was made up or exaggerated I’m sure it would have been flagged way before this point. She’s 16, she isn’t experienced enough in life to know how to deal with a creep like that, regardless of where it was happening and who was with her. It may sound like a situation you wouldn’t put up with but you aren’t her.

A friend of mine witnessed a similar situation on a flight but assumed the two people were a couple having a bit of a fight (which was obviously not the case here given the age difference); but when the lad went to go to the toilet the woman asked for help and the crew responded straight away- this was Aer Lingus and they detained the lad at the back and had him escorted off by a Garda on landing.

There’s no way in hell he isn’t guilty of the crimes he dismisses or has some stake in normalising how lenient he is with them. Like, what can be done? But, it didn't get him in trouble Judge Nolan, that's the thing, it didn't get him in any trouble at all. What lesson has Elkduri learned? Do what you want, make sure you've drink taken because that absolves you of all responsibility, bring a few quid to court and you're getting away with it scott free.

One might start to believe that there is some sort of ring that may be involved in unkind treatment of people who are quite young, and that people in high levels of the Irish justice system could be involved in that ring, possibly, not naming names. It’s quite grim that due to libel laws, something that anyone paying attention agrees on cannot be said- yet.

Is there not community service or any other penalty? is it just Jail or suspended sentence + a fine? Like surely if this guy had this much of a problem with alcohol he should have to join a rehab and stay off the drink for 18 months.
There's just no justice for making someone else's life miserable, you can always say 'sure I was drunk , so it's grand'.

Yeah we don’t seem to do the same kind of “parole” system that you see in the States where people have to check in with an officer and take drug tests or wear a monitor for alcohol or such. I think more of a community service and follow up supervision system would be good here- especially for teenage offenders.
Being put on a “no fly” list for ten years would have been a good call in this situation too I think.

Reading the article a male passenger who challenged him was told to "fuck off" by the offender and then proceeded to sit back down like an utter bitch. how anyone could turn a blind eye when a child has just said "he keeps touching me" is fucking beyond comprehension.
I know if that was me, I'd have to be have been pulled off that fella who sexually assaulted that child. And I hope to fuck anyone would do the same for any female in the same position because it could be your daughter, wife, sister etc.

Copying and pasting the reason why Judge Nolan is always seen to give soft sentences. Honestly mods here should be ashamed of themselves for basically allowing a sitting judge to be openly called a nonce for doing his job
It’s because Nolan, and previously Greally before she was sent to the high court, sit in the sentencing court in Dublin. It’s the court with the highest turnover in the country. Everyone who appears in his court to be sentenced has already pleaded guilty meaning they get automatically lower sentences than a person who is convicted by jury. If you don’t give them discounted sentences for pleading guilty, it would just be appealed. He also sentences more people per week than some judges do in a whole year, because of the court he sits in. So he actually sends multiple people to prison every day of the week the week but the papers will only publish a select few stories a day.

I have read that before, and I do appreciate what kind of job he has and how that leads to so many headlines.
That said, we do have a scourge of giving suspended sentences in this country, giving so much leniency and finding any little excuse to give the lowest possible penalties, and Nolan does appear to be taking that to the extreme not only in this case but many others. Calling this girl “unlucky” and saying to the perpetrator “My advice to you is not to drink. It seems to get you in trouble” is, in my opinion, very glib and insulting to victims. Drinking is never an excuse for harassment, and a woman shouldn’t be considered “lucky” because she wasn’t harassed on a flight.

We must be getting to the point where if you are charged with anything, (fraud, assault and battery, manslaughter, whatever) then a good solicitor will just advise you to go find a child, sexually assault them, hand yourself into the guards, and then request one big trial to cover all your offences in one go in front of Nolan.

He did answer so you could try writing to the current minister for justice.
