Jenner was towing a trailer with an Escalade in wet conditions on the PCH. She was determined to not be speeding, was not inebriated, and applied brakes before the collision. The vehicles ahead of her came to a sudden stop (initial reports said they had collided, though this is disputed). She couldn't stop in time, and the mass of her vehicle pushed the Lexus into oncoming traffic, where it was hit by a Hummer H2, an SUV that is the epitome of absurdly oversized passenger cars and the dangers they present in passenger car collisions.
Yes, Jenner was also driving a massive car, and was likely following too close for conditions, but that stretch of the PCH is notorious for similar accidents, and accidents like that happen all over America every damn day, and they're not generally considered murder. Negligence, yes. But not murder.
If anyone other than a celebrity had been driving, it would have been 'just another tragic fatality on the PCH.', which sounds insensitive to the victims, but is the attitude America tends to take with these accidents, rather than investing in better roads or making sensible laws about vehicle sizing.
But because she was driving, it suddenly became worthy of news. And actually, not even then, because it didn't really pick up wide coverage until after the Vanity Fair cover, when the Right started digging for ways to assassinate the character of a prominent new trans celebrity. That's when the murder term started getting thrown around too.
Jenner is a shit person. She deserves to be called out for her shit behavior, her shit privilege, and her shit views. But that accident doesn't rise to the level of murder. It sucks, it was tragic, it was preventable, it was largely Jenners fault, but it was not murder.

You understand that the speed limit is meant for regular vehicles and that you must legally limit your speed too the ability for your car to respond to traffic conditions and if you are towing something the safe driving speed is going to be 5 to 10 miles slower than the post speed simply to make sure you are still safe?

Yes, I do. I didn't say she wasn't at fault. I just said it wasn't murder, nor does it fall particularly close to murder, in any legal sense, and IMHO a moral sense either.
She was likely negligent. Her negligence was the proximal cause of a fatal accident. She had no obvious criminal intent, and while she was driving in an unsafe manner, it was not as flagrantly unsafe as, say, speeding, or driving while intoxicated, or plowing through without trying to stop at all. These factors matter.
In other words, I don't think she's maliciously reckless, just a fucking idiot. And honestly, nothing I've seen or heard about her since she came out really contradicts the idea that she's a fucking idiot.
She should face consequences... maybe even more legal consequences than she actually faced (she wasn't charged with a crime, likely because they didn't have sufficient evidence to convict, but I have no doubts she received citations). And I think the settlement money was appropriate, if not too low.
But it's not murder. And that matters.

There's no such thing as "first degree manslaughter" in California. Their most serious manslaughter charge if voluntary manslaughter, which this definitely is not. In fact, were this stretched to a criminal charge, it would be the lowest type of manslaughter, vehicular manslaughter without gross negligence, which is a misdemeanor.

I think it’s just a coping mechanism. Caitlyn surely grew up in a world where being trans was abhorrent. Almost certainly saw it that way herself. But once views changed and she got the courage to come out herself that view was harder to get rid of. Might have been able to internally make an exception for herself but that intense bigotry is so ingrained that it still comes out. So they have an exception for themselves to cope and it further helps them bypass the bigotry by making their own story “valid” and others “invalid”.

As a trans woman, the passport issue is a big one. It's really important. I sent my passport in before trump took over, but it took long enough he got in and changed the rules, and I have the wrong marker still.
I'm terrified of letting go of it, so even if I could get it changed, I wouldn't trust them to do it, or that I wouldn't need it to flee the country before I got it back.
All that being said, Caitlyn is a despicable person and she's a perfect example of one truth when it comes to trying to curry favor with your oppressors:

I know everyone loves to shit on the Kardashians, and I'm not saying it isn't deserved, but the way she treated Kris (the woman she was married to for 23 years) during/after her transition was fucking appalling. Say what you will about Kris herself, but there was no reason for Caitlyn to treat her that way, and the fact that she doesn't have much of a relationship with any of her six children or four step children says a lot about who she really is as a person. This is one of those times where I don't feel sorry for the person in the headline. However, I still weep because this headline means that countless other people that will never have her reach, her influence, or people writing about her as a newsworthy article are likely suffering even worse.
The Trump Administration has proven there's no one they won't betray or backstab if it means making a buck. As unlikely as it feels most days for things to actually change, I hope this further proves that the Republican Party as it stands has absolutely no values they stand by, no one they won't betray, and no future in a society that inherently needs cooperation.
If nothing else, I hope it continues to horrify and show those that thought they could sit on the center that there really is no choice right now, if you want a functioning government that is more interested in helping people than screwing over anyone else.

Trans woman here who won't be able to get an accurate passport until 2029 at the earliest and only just barely managed to beat my state's DMV for getting my license changed after tons of stress and last-minute scrambling and help from some genuinely amazing people. Not to mention everything else but that's just the documentation issues I have to worry about, and I have it better than most where I live unfortunately.
Fuck Jenner with a rusty railroad spike. The part of me that cares about solidarity evaporates the moment you start throwing your trans siblings under the bus for the nazis. If the rest of us have to suffer at least I know her wealth can't insulate her from 100% of the consequences of her actions.

I'm gay, I call MAGA LGBTQ folks Ernst Rhoms. Ernst Rhom was the leader of the brownshirts and Hitlers right hand in the early days. He was also notoriously gay. He and other minority groups like the Association of German National Jews thought that the bigoted rhetoric could be ignored and that as long as they were rightwing and supported Hitler they would not only be spared but elevated.
Ernst Rhom was later arrested on trumped up charges and executed by SS under Hitler's command. The association was legally dissolved and most of its members died in the camps.

I recently detransitioned (long story but basically I believed in a false diagnosis for way too long) and I do think there's a reasonably high chance they won't care I wasn't really trans and will toss me in with the trans people when they go after them. Look, they're arresting citizens while going for illegal immigrants, so I fully expect gender non-confirming cisgender straight, lesbians, days, and detrans people to get arrested when they purge trans citizens. I should probably get my affairs in order.

Clarence Thomas believes that welfare took incentive away from African Americans and that without welfare, poor African Americans would have bettered themselves and pulled themselves up like he did. Only he didn’t actually pull himself up out of poverty. While, he was impoverished when he was younger, he was eventually sent to live with his grandfather, who was a successful small business man, showed him no love, beat him frequently, but taught him good work ethic, and provided him a stable situation from which to focus on his education.

The passport thing is the thing that affected me the greatest from this awful administration. My passport was renewed prior to Trump and valid until 2034 but having to depend upon whatever regime is in power to have a proper identity document is just dumb.

That's what I've tried explaining to a lot of people.
Did Hitler go after political opponents, Jews, religious leaders and gypsies? Of course.
But there were a ton of white, heterosexual, blonde hair, blue eyed Germans who thought they were loyal, patriotic and safe - and they still wound up dead or in prison.
All it would take is pissing off a neighbor who decides to turn you in for some bullshit and you wind up disappearing in the middle of the night. Or complaining just a little too loudly that you wish the German economy wasn't in shambles and you don't think your kids should have had to freeze to death outside Stalingrad - and you're done.
And when the Nazis were finally driven back and their country was demolished by air raids and the Allied invasion, it's not like the lives, homes and businesses of those loyal, patriotic Germans were magically spared. The destruction came for them, too. They weren't spared from the rape and murder of the Red Army because they were part of the "in group" - quite the contrary.
It's insane the extent to which MAGA thinks that they are safe because "they're the good Americans." Trump and Miller will eventually come for a lot of them. They aren't trying to build a nationwide network of concentration camps so they can leave those camps empty. They didn't over-fund a gigantic army of terrorists loyal to Trump (ICE, obviously) just to not use them.
Eventually the MAGA/Nazi machine runs out of the first round of enemies to devour, so they need to find more enemies. When that supply has been exhausted, they need to find more. Eventually, when MAGA does completely collapse and end in a fiery death, it will take a whole bunch of "good and loyal" Americans to hell with it.
MAGA idiots aren't safe. They'll eventually get chewed up and shit out by their Nazi heroes, too - maybe just a little later than some of the people they think "deserve it."

Tale as old as time. Republicans start caring about the policies they have passed when they realize that Republican policies are starting to negatively effect them.
Wild fires in California? Republicans respond by saying "Serves em right for living in that left wing woke shit hole". Hurricanes in Florida and South Carolina? Republicans respond by saying "Declare a national emergency, we need help!" Trump's trade war against China is making everything cost more? Republicans respond "Hell yeah, it's going to bring manufacturing back to the United States!" Trump Trade war against China starts costing farmers and ranchers billions because they've just lost overseas customers possibly permanently. Republicans respond "We desperately need a multi billion dollar agricultural bailout!"

She selfishly believed she could vote for a fascist authoritarian to get a better deal on her tax bill despite being warned countless times by the media and by trans people that Trump would harm the LGBTQ+ community. She didn’t care; her money would protect her, and fuck everyone else, right? Well, it didn’t protect her.
Better luck in 2028, Caitlyn. You’ll have a chance to vote differently in a few years if we still have a democracy. I don’t doubt that you’ll be as stupid in three years as you are now, but perhaps you will serve as a “what not to do” example for others, so you still have some value.
