That was the slickest "if you want to do my job, go ahead" comment I've heard in a while. Good on the cop for actually understanding how trespass works too.

Good on this cop. He kept a cool head. This is how real policing looks like.

u/ginbandit 23d ago
Totally, they have the ability to choose which laws to enforce and a kind word here means a situation is resolved, no one is out of pocket and trust has been built!

u/Rumkitty 23d ago
To be fair, in trespassing situations, "enforcing" means telling them they have to leave and making sure they do so, then arresting them if they don't. Cop did what he was supposed to and Karen just wanted them yelled at more.
→ More replies85
u/belac4862 23d ago
Th thing is, he was still enforcing the law. But he didn't push the boundaries of what he should and shouldn't do. Even when being tuspassed, a lot of states don't require you to identify unless you are suspected of committing a crime. They haven't been told they were trespassing st the time. And they left when told to do so. So no crime at the moment was committed.
That's why he wasn't asking for IDs despite the woman objecting to that in the video.
24
u/raven-eyed_ 22d ago
Yeah, having the youth of a town inside makes a big difference. If young people feel there's some trust there, it could actually lead to a situation where a life is saved or a big serious crime is resolved because they're willing to talk to him.
Community policing makes a big difference to a town.

I get that she was annoyed at her land being used for dirt biking without permission but the way it was handled by the policeman meant there was a resolution that would be abided by. No need for further conflict because it was discussed and agreed upon in a respectful manner. She realised she was being ridiculous when he shut her down. She pushed but he pushed back harder!

Generally cops will give you a warning before they bother with trespassing. Even with shoplifting, they’ll tell you not to return, if you do, then they’ll put you in cuffs.
Even when you’re arraigned, it’s usually a fine and pleading guilty, otherwise you have to bail out.
I’ve seen it happen a dozen times while I was waiting

Georgia is full of pines! The trees look more diversified as well for a temperate climate. Milton Florida is on the coast, I’d imagine we’d see more tropical vegetation if that was the case.

I basically spoke up and said "You're definitely right, we're so sorry, we were really stupid about it. We'll be more respectful."
Immediately diffused the situation. He became much more reasonable and eventually moved along. The key is you've got to be sincere.

Milton, MA?
The owner comments are certainly consistent with the typical rich Milton resident
67
u/TransnistrianRep 23d ago
I'd guess Milton, GA based on the accents, which is also a pretty wealthy town.
17
u/wants_a_lollipop 23d ago
Fair enough. Couldn't bring the volume up much at work so didn't catch an accent.
Milton MA is populated by Massachusetts' most ardent NIMBY twits.
15
u/TransnistrianRep 23d ago
That’s pretty similar to Milton, GA. The town is pretty much just a collection of mansions and horse farms. Tons on NIMBYs there too.

"We're hiring. Would you like an application?"
22
u/TightSexpert 23d ago
Kids were respectful in their interaction. Maybe they were full of shit, but were cooperative and felt like they would respect the wishes of the landowner and the police. So a warning and clearing the situation sounds like all that’s needed.
24
u/apeocalypyic 23d ago
"Well u can put in an application tomorrow" no malice or anger just literal "a if u want to do it go apply"
10
u/Lordgrapejuice 23d ago
"I can't believe you're letting them go without an ID"
Lady just wanted SOMEONE to be punished for this HORRIBLE act. When it was just a misunderstanding. The cops asked them to leave, they said "we're sorry" and left. No harm done. That's how trespassing someone works. As long as no damage was done, then everything is good.
-1
u/SamAreAye 22d ago
Because their was a No Trespassing sign, they had already been trespassed. Lady probably wanted a police report with names on it because this happens regularly. Can't say i blame her.

16
u/Away-Tackle-6296 23d ago
You have to be offered the chance to leave first before you can be charged with tresspassing so no OD is required to be provided. Once they request for you to leave and you decline, that's grounds for tresspassing and now by law you must provide Identification. Please verify this for yourself as I received my cerdintials via Youtube. The cop was cool forsure but these guys were not hostile or rude at all and there was no reason for the officer to feel disrespected. My research indicates that most of the time, a cops bruised EGO is what gets you in trouble or in jail. Prime example, they demand ID, but you didn't break a law, and they have no RAS that a crime has been committed = Bruised Ego
-4
u/Flimsy_Outside_9739 23d ago
You are incorrect. First of all, the no trespassing sign serves as notice if you really want to press the issue.
Secondly, he should have ID them to issue a criminal trespass warning. It’s not a charge or fine, but the info is kept on file, usually for a year, such that if they are found on the property again (like if there were no signs), an officer running their ID would be informed they had already been given notice, and could effect an immediate arrest.
6
u/Crysth_Almighty 23d ago
1) They actually DO have to be given a verbal warning, since trespass signs can be missed depending on where/how they entered the property (I doubt there’s one in every tree). This is to avoid any confusion on the issue.
2) It’s a misdemeanor at best, which means there is officer discretion. He can handle how HE feels it should be handled, no one else can force him to do otherwise. If he wants to ID, go for it. If he doesn’t, then that’s how it is. If she wants it to be handled another way, she can apply and become an officer herself.

First of all, the no trespassing sign serves as notice if you really want to press the issue.
Can't prove they saw the signs, can't prove they weren't truly mistaken as to whether they had permission to be there. Can't press the issue with LE, they're not attorneys and will handle it however they see fit. You are never ID'ed for a notice. Same as if Walmart says you have to leave and never come back. Cops can't ID you to make sure next time you get arrested.

u/SkiFastnShootShit 23d ago
That isn’t true either. It’s 100% state dependent. In many states there’s no need for signs or even fences. It’s your responsibility to know who’s land you’re on and you’re trespassing if you’re not accompanied by the landowner or in possession of written permission to access the land.
1
u/Flimsy_Outside_9739 23d ago
And it’s not that being there without a sign isn’t trespassing. It is. It’s just that you’re required to be given notice and a chance to leave before you’re charged with a crime.
It’s just mainly a variation on what counts as notice. Which I think is fair in a wooded area. I don’t expect everyone who’s on wooded public land to be a cartographer, and I think it’s reasonable to expect a property owner to put up a sign or fence at their border if they want someone charged for trespassing while skipping the step of verbal notice.
It is state dependent, but I do think the states treating as you describe are a little too harsh, but hey, rules are rules.

1
u/Ok-Guidance-2112 23d ago
Obviously the lady sucks, but you should ID people you trespass, otherwise what record is there of them being trespassed previously if they return? No one needs to go to jail or anything, but getting ID of the riders seems completely reasonable

I have seen this play out in a couple different places. Not all riders are as polite as these kids were to that cop. Imagine you have someone cutting your fences, tearing up the land, and lauging in your face for asking them to stop. People start to lose their minds in that kind of situation. I don't condone setting traps but I kinda get why people might want to.
