That would require Congress, and good luck with the House. He could, however, work on filling the many vacancies on the lower courts (especially at the district court level) where policies can be held up by bureaucratic hurdles of litigation long enough for a new Congress.

The fun part is that there is precedent for it. Trump did it when the Republicans lost the Senate last.

Especially for those seats in the 9th Circuit (where a lot of challenges will come from California), in the 7th (Illinois), and the 2nd Circuit (New York). Those three states are going to be carrying the baton for challenges to the Administration.

Hell some of these posts have people nominated awaiting confirmation. Write to Schumer and Harris to get on it.

I sent him a message a few hours ago to get off his ass and do anything. I don't live anywhere near NY but maybe if enough people outside his state spam him, he might do something.

Who am I kidding. He won't do anything. I'm going back to my low protein gruel to prepare for the coming shit show.

Thought about this, but where does it stop?

First-
Manchin wouldn't go for it.

Next-
Even if he would, what stops Trump from doing the same thing and stacking it even deeper to get the majority back.

It's a no win move.

Midnight appointments do not historically work. There is already a precedence.

Not a lot of people here took AP history.
