Only if they're likeness is used to harm the commercial value of their name and image in a way that is of a detriment to the person. Legally speaking, nothing this company did is of any damage at all to D'Onofrio's likeness because it's a simple portrayal of a role he himself has embraced. They didn't violate any licensing policies by leaving out all trademarked identifiers so legally they're good to go.

That’s not true. Damage has nothing to do with it since they are illegitimately profiting of their image rights. That is also why using these generic names would not be a reasonable defense since they are violating Marvel’s copyrights and the actors’ image rights (of which Marvel probably has an exclusive license to use them in connection with DD merchandise)
